Regulations for the Wall of the World project membership
1. Terms used in the regulations:
1.1. Author – Wall of the World Ltd. which is registered in the Republic of Latvia Company Register as of 9 November 2005 under the unified registration number 41203025262 and which is implementing the Project under these Regulations;
1.2. Project’s Member – any natural person, regardless of the person’s race, colour, gender, language, religious beliefs, political or other affiliations, national or other origins, financial position, caste or other circumstances, registered in the Database in compliance with the registration procedure developed by the Author;
1.3. Project – the Wall of the World implementation plan which is developed by the Author and comprises of:
1.3.1. setup and maintenance of the website www.walloftheworld.org;
1.3.2. creation and maintenance of the Database;
1.3.3. registration of the Project’s members and their personal and additional data in the Database;
1.3.4. construction of the Wall of the World and the engraving of the personal data of the Project’s members;
1.4. Database – a data processing system developed, maintained and safeguarded by the Author for the registration of the Project’s members and their details under these Regulations; the Database is registered with the Data State Inspection in compliance with the laws of the Republic of Latvia;
1.5. The Wall of the World - a construction which is to be built in the course of the Project and whose concept is described in detail in section Facts of the website www.walloftheworld.org;
1.6. Regulations – these regulations which are developed by the Author for joining the Project and which are to be accepted by the Project’s member when entering data in accordance with the registration procedure developed by the Author.
2. The Project’s aims and purpose
2.1. The aim of the Project is to build the Wall of the World in accordance with the description (concept) published at www.walloftheworld.org in the section Legend and the actual design features in the section Facts.
2.2. By participating in the Project:
2.2.1. each Project’s member joins in the creation of the world wonder – The Wall of the World;
2.2.2. each Participant ensures that his or her personal details are preserved for future generations via registering them in the Database and having them engraved on the Wall of the World.
2.3. The ground principles for the Project’s realisation are as follows:
2.3.1. equality – each Project member who abides by these Regulations has equal opportunities to exercise his or her Project member’s rights;
2.3.2. cooperation – the Project is being implemented only through cooperation, namely, if 65 000 000 people register for participation (i.e. approximately 1% of the world’s population). By accepting these Regulations, the Project’s members confirm that they know and agree that the building of the Wall of the World will start only after 2 000 000 people register for participation and that the construction of the Wall of the World will be completed in 16 months after the date when the Project’s membership reaches 65 000 000.
2.3.3. perpetuity and inalienability – each Project member who abides by these Regulations is granted perpetual and inalienable rights to the Project’s membership (including the inalienable right for registering their personal details and having them stored on the Database and engraved on the Wall of the World).
2.4. Neither the Project’s members nor the Author may under this Project act in prejudice to the principles mentioned in paragraph 2.3. nor otherwise infringe upon the basic human rights and liberties. On the website www.walloftheworld.org the Project‘s members are prohibited from displaying discriminatory attitude to any race, colour, gender, language, religious beliefs, political or other affiliations, national or other origins, financial position, caste or other circumstances. Breach of this provision is at all times considered a grave violation following which the Author may discontinue the Project member’s affiliation.
3. Project’s financing
3.1. Project is financed from the following sources:
3.1.1. Income from the Authors’ commercial activity;
3.1.2. Donations made by natural and legal persons;
3.1.3. Investments made by legal persons.
4. Main rights and obligations of the Author
4.1. The Author’s obligations:
4.1.1. to maintain continuously the operation of the website www.walloftheworld.org by publishing the actual total Project membership count and the details of the Project’s members mentioned in subparagraph 5.1.1. and paragraph 8.6. of the Regulations; occasional disruptions of the website’s www.walloftheworld.org operation or disruptions arising from circumstances beyond the Author’s control will not be considered as a breach of the Author’s obligations under these Regulations;
4.1.2. as far as possible to make the public aware of the Project with a view to providing an opportunity for a maximum number of the world’s population to join the Project; to provide the public with access to the Author via the e-mail: info@walloftheworld.org;
4.1.3. to ensure that after the Project’s membership becomes 1 000 000 strong, the Authors provides the participants the opportunity to choose via voting the state, where the Authors will construct the Wall of the World. Author will choose one from the Top 5 states the most suitable for construction, and will obtain the most suitable for the construction plot of land, with a total area of 40-48 hectares or more which is found in the secure location which is free form natural disasters such as tornados or earthquakes and other. Author’s title to the Wall of the World will be registered in accordance with the laws of the corresponding state;
4.1.4. to organize and manage the Wall of the World Project in line with the Wall of the World description (concept) published on www.walloftheworld.org;
4.1.5. initiate, organize and manage the Wall of the World construction process immediately after the necessary funds will be available, raised from sources mention in Section 3;
4.1.6. to publish review on received income in each 6 (six) months mention in Section 3 of the Regulations, and their utilization;
4.1.7. on showing of the certificate specified in paragraph 7.1. of the Regulations to admit the Project’s members to the Wall of the World territory, after the completion of its construction and its opening to the public, free of charge.
4.2. The Author may partly or fully assign the rights and obligations under these Regulations to any third party on condition that such third party carry on the Project in compliance with the Regulations and not dismantle or demolish the Wall of the World.
4.3. Subject to the company’s board resolution the Author may amend these Regulations except for section 4 of the Regulations and unless the new Regulations are retroactive. All amendments to the Regulations will be published on the website www.walloftheworld.org.
5. Project membership registration procedure
5.1. A person may join the Project and enjoy all the member’s rights stipulated in the Regulations upon completing the following registration steps prescribed by the Regulations:
5.1.1. by entering for registration into the mandatory fields shown on the website www.walloftheworld.org his or her Personal Data – name, surname, place and date of birth in accordance with the provisions of section 6 of the Regulations and by confirming that he or she is willing to participate in the Project and that such personal details are to be registered in the Database, published on www.walloftheworld.org and engraved on the Wall of the World;
5.1.2. by entering for registration into the mandatory fields shown on the website www.walloftheworld.org his or her e-mail address which will not be made public and which the Author will use exclusively for correspondence with the respective Project’s member;
5.1.3. by agreeing that the Project is the eighth wonder of the world via checking the mandatory checkbox found on the website www.walloftheworld.org;
5.1.4. by accepting these Regulations.
5.2. Upon completing all the steps mentioned in paragraph 5.1 of the Regulations, and Author has verified and confirmed steps completed by the person, the person is registered in the Database and effectively becomes the Project’s member with the right to cancel the membership only in the cases stipulated in the Regulations. The Author completes the review and confirmation of the data provided by Person within 1 (one) business day after Person has completed all the steps mentioned in paragraph 5.1 of the Regulations.
6. Mandatory requirements for registering personal data
6.1. A person may be registered in the Database only if the Personal Data specified in subparagraphs 5.1.1. and 5.1.2. are entered accurately and comply with the following requirements:
6.1.1. the information is entered with Latin letters;
6.1.2. the total number of characters for the name, surname and city (town or other location) does not exceed 42;
6.1.3. the birth data is in the following format: DD.MM.YYYY.
6.2. The Project’s applicant must enter for registration his or her true personal data. Entering falsified data or data of other persons in www.walloftheworld.org is prohibited.
6.3. A Project’s membership may be discontinued or deleted for the following reasons:
6.3.1. the person has failed to observe any of the requirements laid down in subparagraphs 6.1.1. to 6.1.3. or paragraph 6.2.;
6.3.2. the person has entered details that contradict the requirements of paragraph 2.4. of the Regulations or information that is rude or non-aesthetic.
6.4. In the cases stipulated in paragraph 6.3. the Project’s member is considered to have committed a grave breach of the Regulations and the Author may unilaterally and irrefutably discontinue the membership of the guilty Project’s member.
6.5. In the event the Author finds multiple registrations of the same person in the Database the Author may delete the repeat personal data but uphold the right of the Project’s member to keep a single copy of the personal data in the Database with a single entry on the Wall of the World.
7. Confirmation of registration
7.1. Not later than in one working day of completing the registration steps as prescribed in section 5 of the Regulations the Author will e-mail to the address of the Project’s member mentioned in subparagraph 5.1.2. of the Regulations the PDF Certificate (Portable Document Format - an electronic document that must be read with the Adobe Acrobat computer program), hereinafter called the Certificate, which will serve as the confirmation that the Project’s member has registered with the Database. The Certificate will indicate where the personal data of the Project’s member will be located on the Wall of the World by sector, wall, side of wall and sub sector. If necessary the Author may change the location for engraving the personal data of the Project’s member on the Wall of the World. In such a case the Author will advise the Project’s member by e-mailing an altered Certificate to the member’s address mentioned in paragraph 5.1.2. of the Regulations.
7.2. If a Project’s member has deleted or otherwise lost the message with the Certificate e-mailed by the Author, the Author will be under no obligation to replace the Certificate.
7.3. Upon completing the registration a Project’s applicant may at the same time request that a hard copy of the Certificate is posted to him or her at a charge stipulated by Author. In this case the Author will provide for the delivery of the Certificate within 25 working days of the receipt of the payment of the charge for Certificate delivery into the Author’s bank account.
7.4. If a Project’s member has requested a hard copy of the Certificate under paragraph 7.3. of the Regulations but has not received such by the term specified the Project’s member must immediately advise the Author at: info@walloftheworld.org and provide his or her personal data and the date when the data was entered for registration. The Author is under obligation within 10 (ten) days of the receipt of the message to clarify the reasons for the non-delivery of the Certificate. If the Author is found to be at fault, the Author in five days of establishing the fact will ensure a repeat delivery of the Certificate without charge; if the Author is not found to be at fault and the Certificate has not been delivered due to the Project member’s fault (including but not limited to wrong address; the Project’s member refused to take the delivery; the delivery was taken at the address indicated by the Project’s member, etc.) the Author will not make a repeat delivery of the Certificate.
7.5. After the sending of the Certificate, the Project’s member may view his or her registered personal data at www.walloftheworld.org in the publicly available section of the Database - Browse the Wall. The Project’s member may do so by using the browser function of the Browse the Wall section where the registration number indicated on the Certificate or the name and surname of the Project’s member are entered as search fields.
7.6. If for technical reasons the Author changes the planned place for the engraving of the project member’s details, the Author, no later than within 3 months of establishing the fact, must send a revised copy of the PDF certificate to the e-mail address indicated by the member.
If under paragraph 7.3 of the Regulations the member has ordered and paid for the delivery of a hard copy of the Certificate, the Author, no later than within 3 months of establishing the fact, must for free send the revised Certificate to the postal address indicated by the member
8. The rights and obligations of the Project’s member
8.1. The Project’s members have the following rights:
8.1.1. to make themselves aware of the progress of the Project in accordance with subparagraph 4.1.1. of the Regulations and the information about the design and construction of the Wall of the World and other information regarding the details included in the Database in compliance with the provisions of the Law for the Protection of Personal Data of Private Individuals;
8.1.2. pursuant to paragraph 7.1. of the Regulations to obtain the Certificate confirming the registration with the Database;
8.1.3. to exercise the rights mentioned in paragraph 8.5. of the Regulations for entering additional data for registration;
8.1.4. from the very registration until the Author has announced on the website www.walloftheworld.org that the Project member’s data will be used for designing the Wall of the World inscriptions the Project’s member may revoke his or her membership by giving a notice to the Author at the e-mail address support@walloftheworld.org, not providing the reasons for the revoke. Author will delete the personal data from the Database.
8.2. The Project’s member may not:
8.2.1. after the term mentioned in paragraph 8.1.4. of the Regulations request that the personal data be deleted or amended pursuant to subparagraph 5.1.1. of the Regulations unless the personal data are inaccurate or incomplete or in other cases mentioned in subparagraphs 8.1.4 to 8.1.5. If the Project’s member requests that his or her data be deleted or amended in cases specified by the Regulations after the Author has announced that the Project member’s data will be used for designing the Wall of the World inscriptions the effected changes will only apply to the Database;
8.2.2. choose the location for engraving his or her personal data on the Wall of the World;
8.2.3. enter into the website www.walloftheworld.org information which contradicts the requirements of the Regulations.
8.3. The Project’s members are responsible that the data they enter are true and that they have entered it of their own free will.
8.4. No person may enter for registration another person’s data.
8.5. The Project’s members may, concurrently with the personal data specified in subparagraph 5.1.1. of the Regulations, enter for registration the additional data specified in paragraph 8.6. of the Regulations which will be available to all visitors of the website www.walloftheworld.org in the public section of the Database. When registering the mentioned data, the person agrees that the data will be registered on the Database and published in the public section of the Databases of the website www.walloftheworld.org .
8.6. The Project’s members may enter into the public section of the Database of the website www.walloftheworld.org the following additional personal data: country of residence, telephone number, postal address, personal photo, e-mail address, personal profile and a message to the world. The additional data must comply with the requirements of paragraph 2.4. of the Regulations. If the Author has grounds to believe that the data are not true or if the data do not comply with the requirements mentioned in paragraph 2.4. of the Regulations, the Author may without giving any explanations to the Project’s member discontinue the membership of the Project’s member without providing any compensation.
8.7. The Project’s member confirms that he or she knows and agrees that the website www.walloftheworld.org has two alternative addresses - www.walloftheworld.com and www.walloftheworld.net and that the applications for the Project’s membership can be registered at only these three website addresses. The Project’s member should note that any other persons who pose as the Author or the Author’s representative without appropriate authorization and who offer to join the Project or offer Project related services or options do not represent the Author and the Author is not liable for the actions of such persons.
8.8. The Project’s member confirms that he or she knows and agrees that:
8.8.1. donation and purchase of Certificates mentioned in paragraph 7.3. of the Regulations are not the obligatory condition for the participation in the Project, but is the voluntary choice of Project member only;
8.8.2. donations for the Project and payments for the Certificates mentioned in paragraph 7.3. of the Regulations (in Project member made donation or has purchased certificate) are subject to refund.
8.9. Upon entering the personal data for registration the Project’s member agrees that the Author or the Author' s successors will have the title to the Project and its outcome – the constructed Wall of the World.
9. Privacy statement
9.1.1. The Author will use the personal data and the additional data entered by the Project's members only in compliance with these Regulations for the purpose of implementing the Project.
9.1.2. Upon entering the data for registration the Project's member consents to his or her personal data being processed in the Database and agrees that his or her information mentioned in subparagraph 5.1.1. of the Regulations – that is, the personal data, the person’s certificate number and the location of the personal data on the Wall of the World (by sector, wall, wall side, subsector) will be displayed at www.walloftheworld.org in the public section of the Database - Browse the Wall; persons who have entered for registration additional data in accordance with paragraphs 8.5., 8.6. of the Regulations agree that such additional data will be published in the same manner.
9.1.3. The Project’s member is aware and agrees that the personal and additional data registered in the Database will be available to all visitors of the website www.walloftheworld.org, and to all persons who will visit the Wall of the World after its construction and unveiling to the public as well as to all persons involved with the building of the Wall of the World.
9.1.4. The Author will process and protect the personal and additional data registered in the Database in compliance with the applicable laws and regulations of the Republic of Latvia.
9.1.5. The Author will take any reasonably expectable measures to protect the personal and additional data of the Project’s members against damage arising from unauthorised interference with the Database.
10. The membership fee
10.1. Project membership is free of charge. An applicant for the Project’s membership is registered in the Database only after the person has confirmed his/her data entered at the website www.walloftheworld.org in the section Add Your Name and Author has verified the data
11. Force majeure and unlawful acts of third parties
11.1. The Author is not liable for non-performance of his obligations arising from force majeure. As force majeure will be considered changes in the political situation or the laws of the Republic of Latvia that may prohibit the construction of the Wall of the World; fire, floods and other natural disasters that interfere with the construction of the Wall of the World; and other circumstances stipulated by the laws and regulations of the Republic of Latvia.
11.2. The Author will provide insurance coverage for the Wall of the World., If, however, due to force majeure or unlawful acts of third parties the Wall of the World is damaged or destroyed the Author will be under no obligation to restore it.
11.3. The Author will immediately after the occurrence of force majeure and as soon as such have become known to the Author notify the Project’s members by posting an announcement on the website www.walloftheworld.org.
12. Governing law and jurisdiction
12.1. All legal relations between the Author and the Project’s members which are not covered by these Regulations will be governed by the applicable laws of the Republic of Latvia.
12.2. The Author and the Project's members will solve all disputes and differences by mutual negotiations (via electronic media); in case a solution to a dispute or differences fails after 3 (three) months from the start of such negotiations the Author and the Project’s member may refer the dispute to a court of law of the Republic of Latvia.
